Data Protection drives European age verification guidelines on the Internet

The Spanish Data Protection Agency (AEPD) has promoted the development of guidelines for age verification systems on the Internet within the European Data Protection Board (EDPB).

These guidelines were unanimously approved by the plenary of the committee, marking the beginning of joint action by data protection authorities on this issue.

Last December, the agency presented a decalogue that compiles the principles an age verification system must comply with, proposing an age verification system to protect children and adolescents from accessing inappropriate content while ensuring the anonymity of adults in their Internet browsing.

These principles were complemented with a practical and effective proposal for an age verification system and the protection of minors on the Internet against access to adult content, demonstrating the technical feasibility of protecting minors from accessing inappropriate content while ensuring the anonymity of adults in their Internet browsing.

According to the AEPD, the current age verification measures used on the Internet (self-declaration of age, sharing credentials with the content provider, and relying on the provider to estimate the age or on so-called trusted third parties) have proven inefficient or pose risks such as locating minors, lack of certainty about the declared age, exposure of identity to various participants on the Network, massive profiling, or collection and processing of unnecessary data, among others.

Last Tuesday, the Council of Ministers approved the creation of a Working Group led by the Ministry for Digital Transformation, in which the AEPD participates along with other public bodies, aimed at improving the protection of minors accessing content on the Internet by proposing a technological solution that allows for effective age verification while maintaining the highest guarantees of privacy and data protection.

Protecting children and adolescents on the Internet is one of the agency's priority lines of action, as reflected in its 'Global Strategy for Minors, Digital Health, and Privacy.' Furthermore, the AEPD is part of the committee of experts to protect children and adolescents in the digital environment launched by the Ministry of Youth and Childhood.
